Project Overview and Role:

The objective of the CELGA Activity is to build upon both the Sierra Leone Election Dialogue Series (SLEDS) and the Women Empowered for Leadership and Development (WELD) projects. USAID/Guinea and Sierra Leone anticipates awarding a projected five-year activity that will support democracy and governance objectives in Sierra Leone. The project aims to (a) Increase effective and informed citizen and civil society participation in local government and political processes, and (b) bolster the capacity of local governance institutions to provide critical services and be more transparent in their processes.

Palladium seeks a Senior Governance Advisor to support project objectives of the USAID-funded Civic Engagement in Local Governance for Accountability project. S/he will report directly to the Chief of Party. This position will be based in Sierra Leone and is contingent upon contract award to Palladium.

Duration: 5 years (anticipated start in January 2022) Location: Sierra Leone

Primary Duties and Responsibilities:

– Provide technical support and analysis for project governance programming which includes political systems strengthening, peace building, social accountability, civil society strengthening, and city government technical assistance; – Liaise with local and state government agencies in Sierra Leone, consortium partners, and other Sierra Leonean governmental and non-government stakeholders to support project objectives; – Support Chief of Party in implementing programmatic, strategic development, and quality control duties; – Assess technical needs at the district level and propose interventions that respond to those needs; – Design program methodologies, approaches and tools that will improve citizen and CSO engagement in political sphere and strengthen governance structures at the sub-national level; – Comply with USAID and Palladium reporting requirements on program impact and implementation; – Provide training, guidance and oversight to team members to ensure consistency and quality of delivery; – Support continuous learning and adaptation, working closely with the COP and other team members; – Perform other related duties and responsibilities as assigned





Required Qualifications:

Project Development and Management

Organizational Setting

The Swedish International Development Cooperation Agency (Sida), the Food and Agriculture Organization of the United Nations (FAO) and the Economic Community of West African States (ECOWAS) are collaborating on a new 5-year project: Global Transformation of Forests for People and Climate: a focus on West Africa.





The project is implemented by FAO in partnership with ECOWAS, with financial support from Sida, and is key to accompany the implementation of the ECOWAS Convergence Plan for the Sustainable Management and Use of Forest Ecosystems in West Africa , which was adopted in 2013. The Convergence Plan aims to mobilize political, institutional, financial and technical support to address transboundary forest issues across ECOWAS’s 15 member states.

The project’s objective is to strengthen decision-making on forests and land management across West Africa by improving knowledge of forest dynamics, strengthening legal forestry frameworks, and demonstrating and sharing the best community-based forest practices across the region. It is expected that sharing lessons learned and best practice will take place within the region as well as globally.

The project has three priority focus areas: Focus area 1: Knowledge of the state of forest ecosystem dynamics

Focus area 2: Forest and land related laws, policies and strategies at the sub-regional level; and

Focus area 3: Demonstration of community-based sustainable forest and land use practices and encouraging south-south cooperation

Specifically, Focus Area 2 seeks to support initially the development of four or five legal gap analyses, based on country needs that will contribute to sustainable forest management and to addressing transboundary threats to forest ecosystems in West Africa.

In the ECOWAS region, many member states identify weak forest sector governance and institutions, as well as a lack of consistency between laws and implementation across borders, as critical challenges to sustainably manage forests. The African Forest Forum (2014) highlights cross-border trade in West Africa as being essential for livelihoods in the region, yet unsustainable practices such as illegal trade of wildlife and forest products undermine the livelihood benefits that could otherwise be derived. This issue is particularly relevant at a sub-regional level as sawn timber, plywood and fuelwood are traded from the Guinean rainforest countries to Sahelian countries through both legal and illegal channels.





The engagement of local communities in community-based forest management and forest-law enforcement varies across the sub-region but holds potential in addressing the drivers of deforestation including illegal logging and agricultural encroachment. Local communities’ involvement, both in terms of proximity and interest, can help protect and conserve forest resources. Their natural proximity to the forest, deep knowledge of its systems and dynamics, and strong intra-community relationships – enhanced through a sense of ownership based on tenure security – are some of the likely factors for efficient and cost-effective protection of forest resources.

Often community involvement is limited by lack of legal forest tenure rights to access and manage forest resources – rights which if secured, would benefit both local livelihoods and forest management. At the same time, international, regional and sub-regional treaties and agreements that consider a human rights based approach to protect the environment, water, biodiversity, and forests are becoming a priority for legislators and national parliaments.

Cross-sectoral legal harmonization should reflect a balanced approach in promoting economic development objectives along with conservation of natural resources. Any legal arrangement, requires multi-sectoral coordination based on an articulated dialogue involving key stakeholders at multiple scales, and across borders.

During phase I, legal gap analyses will be conducted in four/five countries where forestry legislation is currently under revision or development, and where major transboundary concerns related to forest management can be tackled. In addition to those criteria, countries facing high deforestation rates, according to the technical studies undertaken under focus area 1, will be prioritized.

The Upper Guinea Forest Ecosystem involving five States (Côte d’Ivoire, Liberia, Ghana, Guinea and Sierra Leone) is expected to meet those requirements, due to an expanding and uncontrolled demand on forested land and natural resources, and from the fragmentation, transformation and conversion of the forested lands to other types of land use cover (World Bank 2015). As such, the lack of cooperation and common regulations among the riparian countries is considered a major threat for the sustainable management of existing transboundary natural resources and for the restoration of rapidly degrading ones.





This project will encourage bordering countries to build consensus on transboundary concerns related to natural resources and forests. This may be achieved for example through the adoption of harmonized, homologated and/or multi/bilateral agreements aiming to promote consistency among national laws or to implement regulatory frameworks, with the involvement of local communities and relevant stakeholders.

Under the current circumstances, COVID-19 might imply a stronger pressure on natural resources including forests, and increase illegal activities (illegal mining, poaching etc.) due to reduced enforcement and political attention focused on COVID-19 and economic recovery. For this reason, the activities under this consultancy could be realigned partially to undertake an assessment of the strength of current legal and governance frameworks regulating forest tenure and forest resources, to mitigate the impact of the COVID crisis on forest-related activities, including an assessment of (i) the rights to access forested areas, (ii) the rights to use, extract or protect Non-Timber Forest Products, (iii) agro – forestry encroachments.

Reporting Lines

The incumbent will work under the overall supervision of the coordinator of the FAO sub regional office for West Africa, under the direct administrative supervision of the FAO country office representative and under the technical supervision of the project manager, the forestry legal officer at HQ and the legal officer based at the sub regional office, in close collaboration with the assistant FAOR program of the country office and in consultation with relevant national counterparts

Technical Focus

The objective of the incumbent is to analyse the forest related legal framework, and submit recommendations to promote legal reforms and/or implement the legal provisions required to protect the forests and reduce deforestation in the target region, at the national and sub-regional levels, in collaboration with relevant national institutions and other key actors. The legal report will focus on the major drivers of deforestation and land degradation, taking into consideration a community-based approach and centring the legal gap analysis on forest-related transboundary issues affecting more than one country within the ECOWAS region. This analysis will be done in close consultation with the stakeholders at the national and sub-regional level, including the focal points, the government interlocutors and the relevant local institutions (public, private, IGOs, NGOs, community and decentralized organizations) implicated in the planning and management of forests, natural resources and the environment.





Tasks and responsibilities

The national legal consultant will be responsible for the following tasks:

  • Develop a work plan to be presented within the first 15 days of the consultancy, including the description of the products, the methodology and the timeline.
  • Develop a legal analysis, based on the outline prepared by FAO, focusing on forestry related legislation, taking into consideration regional and international instruments, highlighting existing opportunities, gaps, and inconsistencies among and within forest-related sectors, that affect the sustainable management of forests, specifically focusing on 1) legal gaps that contribute to issues affecting transboundary forest ecosystems, and 2) legal gaps that constrain the full engagement of local communities (including vulnerable groups, women, IPs and youth) in sustainable forest management. A desk review of relevant statutory instruments (including laws, acts, regulations, decrees, resolutions and customary instruments/practices) as well as interviews with key stakeholders from governmental non-governmental entities will be the basis to develop the legal analysis.
  • Based on the legal gap analysis, the consultant will include a set of recommendations to promote legal reforms or implement the forest legal framework, including institutional and multilateral arrangements needed to address transboundary forest issues and to improve sustainable management of community forestry. The analysis should include a review of benefit-sharing schemes, legal (vs illegal) trade of timber and non-timber forest products among countries, forest management planning tools, land and forests tenure security, as well as co-management schemes of protected areas. A gender lens will be applied to the analysis and recommendations.
  • Organize a workshop (or virtual meeting) in close collaboration and under the guidance of the national authorities to share and validate the findings and recommendations of the legal gap analysis, inviting relevant national and sub-regional relevant stakeholders, including the focal points, the government interlocutors and the relevant local institutions (public, private, IGOs, NGOs, community and decentralized organizations) implicated in the planning and management of forests, natural resources and the environment. The FAO country office and HQs/sub regional team will provide logistical and technical support as needed. Relevant stakeholders will be invited to attend the workshop.
  • Present the final legal gap analysis to the national authorities for its final validation, with the aim of promoting understanding and ownership of the analysis and recommendations.
  • Any other duty agreed upon with the supervisor and contributing to the achievement of the successful implementation of the assigned tasks.

  • Knowledge of the structure and normative contents of forestry related legislation at national, regional and international levels
  • Proven ability to build good relationships with a variety of stakeholders, including government institutions, NGOs, and local communities, and conduct fieldwork.

Introduction
The Conservation Society of Sierra Leone seeks to engage an expert to examine the National Protected Area Authorization and Conservation Trust Act and the Environmental Protection Act to achieve improved coordination and integration on implementation of environment-related policies, legislation to promote conservation, protection and sustainable management of the Yawri Bay’s natural resources.





Background.

Yawri Bay is one of nine Key Biodiversity Areas in Sierra Leone recognised in the Guinea Forest Ecosystem Profile and part of the Northern Upper Guinea Ecoregion which is classified as continentally outstanding. It is one of the only four areas in Sierra Leone identified in the Profile (Table 12.2) as a “Priority Site” for CEPF investment. The Bay was designated as an Important Bird Area in 1992 and the Government of Sierra Leone has identified Yawri Bay as one of 15 proposed Protected Areas.
Yawri Bay is one of the most important stop-overs and wintering grounds for birds in West Africa. Forty-six species of Palearctic migrant birds are known to occur in the bay. Four of these species – Avocet, Lesser-crested Tern, Water Dikkop and the near-threatened Damara Tern – were first recorded for Sierra Leone at this site.

The mangroves in this area are under threat particularly for timber and charcoal, and for oil and gas exploration. During 1980-2006, Sierra Lost 37% of its mangrove cover (Feka et al 2014). The trend has unfortunately continued.

Yawri Bay supports a major local fishing industry, especially at Tombo and Shenge, which supplies most of the fish consumed in Freetown. There is also a viable local salt industry in the area. These activities provide employment opportunities for local inhabitants but also pose major threats to the Bay.





Despite Yawri Bay being one of only four areas in Sierra Leone identified in the CEPF Profile (Table 12.2) as a “Priority Site” for CEPF investment; it currently has no legal protection. No government land use policy exists for the area. Legislation designed to prevent over-fishing exists but is poorly enforced.
In summary, the Yawri Bay ecosystem in Sierra Leone has been degraded and is susceptible to further decline. The major threats are the destruction of mangroves, unsustainable harvest of fish and crustaceans, loss of coastal shorelines, and disturbance of animals by people. These threats are driven by gaps in our knowledge of the Bay, insufficient legal protection, non-compliance with existing environmental laws, and the fact that at present residents do not benefit from protecting the Bay.
To address the realized environmental policy and legislative coordination shortfalls, the Conservation Society of Sierra Leone through CEPF is facilitating the examination of NPAA, CTF and EPA Acts and to advise/ recommend on the adequacy and or areas for improvement to ensure effective protection of Yawri Bay if designated a Ramsar Site.

The objective of the assignment
The main objective of this consultancy is to achieve improved coordination and integration on the implementation of environment-related policies, legislation to promote conservation, protection and sustainable management of the Yawri Bay’s natural resources.

Responsibility of CSSL
The organization will be responsible for the following:

Together with CSSL and local community elders, hold two community consultations in each of 5 villages with 50 participants per meeting (20 from host communities and 30 from surrounding communities).

Approach/Methodology
The assignment shall involve a desktop study on regional and international best practices, meetings and workshops with stakeholders, any other undertaking as may be agreed that might be deemed necessary for the production of a comprehensive report. The work shall be undertaken in close liaison with and involvement of the following throughout all stages:
National Protected Area Authority (NPAA)
Environmental Protection Agency (EPA) of Sierra Leone.
Conservation Trust Fund (CTF).
Requirements and Expected Qualifications:
The national consultant refers to an individual.

The national expert is preferably at least Master degree holders in the fields of environmental laws and policies or related discipline.

Minimum 10 years of relevant professional experience in environment-related programs
Sound previous experience in similar projects in the required domains
Demonstrable analytical skills and report-writing skills.
Excellent, proven management and communication skills and fluency in English and Krio language.

Cost estimates and financing
The expenses of the assessment will be covered under the Critical Ecosystem Partnership Funds grant administered by CSSL.

Implementation Timeline and deliverables
This work is expected to be done within three (3) months and to be completed not later than 30th July 2021 including recruitment, inception, validation and final reporting including soft copies and hard copies sent to the Project Manager and Program Manager and the Executive

BACKGROUND

The Government of Sierra Leone’s renewed commitment to supporting the delivery of justice through the respective institutions is an ideal opportunity to tackle challenges in the justice and security sectors amidst the gains already made. In order to continue to strengthen the rule of law, human rights and to further consolidate the peace and ensure a safe and just society, the Government of Sierra Leone through its Justice Sector Coordination Office (JSCO) developed the Justice Sector Reform Strategy and Investment Plan (JSRSIP) IV (2019-2023). To meet the current growing demand for justice, the strategy is aligned to the Government of Sierra Leone’s Medium-Term National Development Plan (MTNDP 2019-2023), which is also aligned to the Sustainable Development Goal 16 (SDG 16).

Over the years, there has been widespread criticism among the people about the state’s general administration of justice. A factor accountable for these increasing sentiments has been the failure of the justice sector to meaningfully engage the public about its work. Notably, the justice sector has recorded meaningful progress in the implementation of its strategic investment plans and other interventions from non-state actors. However, in spite of the gains made in raising awareness on the interventions within the sector, public sentiment is still at its lowest ebb and the sector continues to suffer criticisms and to be negatively judged in the media and other public forums. This has been attributed to poor communication systems that stem from weak stakeholder engagement which culminated to the lack of confidence in the justice system. Improving stakeholder engagement and communication in the justice sector with the public has the potential to strengthen unity and ensure a peaceful, just and inclusive society. Importantly, it will be able to reliably inform the public about government’s interventions in terms of service delivery by showcasing the efforts made in actualizing government’s policy priorities for social services and other welfare issues, including the fight against corruption.





IDLO, with the support of the Government of the Netherlands, is currently implementing a Program that aims to advance Agenda 2030, focusing on the Rule of Law and Access to Justice (SDG 16). Within this Program, in Sierra Leone IDLO is implementing pilot activities on Access to Justice that seek to increase awareness of rights for justice-seekers through programmatic interventions, including through engagement with customary and informal justice systems, applying people-centred approaches. As part of the program interventions in Sierra Leone, IDLO is providing support to the JSCO to develop a comprehensive Justice Sector Communications Strategy. The Communications Strategy will improve justice sector institutions stakeholder engagement and communication with the public to strengthen national cohesion, political stability and economic development thereby transforming the general image of the country’s justice sector.

THE ASSIGNMENT

It is within this framework that IDLO and the JSCO seek to recruit a communications expert to develop a Communications Strategy for the justice sector. The communications expert will work under the supervision of the Coordinator of Justice Sector Coordination Office and the IDLO Regional Program Manager Africa and in coordination with the IDLO Program Coordinator Africa and/or any other reporting line as may be determined by the JSCO and IDLO. It is expected that this strategy will contribute towards ensuring that the Government of Sierra Leone fulfils its mandate of providing sustainable public access to justice through improved public’s access to information about the justice sector and its work with the public.





Within this framework, the consultant will be responsible to undertake the following:

  • Develop and submit an inception report outlining the understanding of this terms of reference, a proposed plan of action and workplan indicating clear milestones and timelines
  • Review key documentation including the Justice Sector Reform Strategy and Investment Plan (JSRSIP) IV (2019-2023), communication strategies or plans of other justice sector institutions, perception surveys on the justice sector etc.
  • Conduct mapping/scoping/identification of key communication channels and platforms available to effectively engage justice sector stakeholder and the general public.
  • Conduct stakeholders’ meetings and consultations with internal and external justice sector stakeholders to identify institutional communication needs and gaps. The consultations will be held, not only in the capital, but – where possible – in other locations in Sierra Leone;
  • Develop and submit a draft Justice Sector Communications Strategy;
  • Facilitate a validation forum with internal and external justice sector stakeholders to review and validate the draft Justice Sector Communications Strategy;
  • Submit the final version of the Justice Sector Communications Strategy; and
  • Final report capturing all the interventions captured during the assignment.

IDEAL CANDIDATE PROFILE

Education and Work Experience

An advanced degree (Masters or Equivalent) in communications, law, international affairs, public policy, journalism, or other relevant field from a recognized university is required.

  • Minimum of seven years of relevant national/international working experience in the area of communications with a background in rule of law or governance;
  • Proven experience in developing communication strategies for different institutions is desirable;
  • Broad knowledge and understanding of the justice sector in Sierra Leone at policy, planning and / or implementation levels;
  • Experience in liaising with governmental bodies while providing communications advice to national institutions. Experience working with justice sector institutions is a significant advantage.

Language

Fluency in written and spoken English is required.

The principal responsibilities of this post are to provide Monitoring, Evaluation & Learning (MEAL), and assuring quality in data management systems – design, data collection/analysis, monitoring, evaluation, and research. He/she will guide policy and planning interventions to respond to child trafficking issues in Sierra Leone, in partnership with African

Responsibilities:
